Please read these Terms of Service (“Terms”) carefully before using the Statium website and SDK operated by MintyGum LLC (“Statium,” “we,” “us”).

By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not use the Service.

1. Accounts

When you create an account with us, you must provide accurate and complete information. You are responsible for safeguarding the password usage of your account.

2. License to Use SDK

Subject to these Terms, Statium grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Statium SDK solely for the purpose of integrating analytics and ad-serving features into your applications.

3. Prohibited Uses

You agree not to:

  • Reverse engineer, decompile, or disassemble the SDK.
  • Engage in any form of “ad fraud” or generate invalid impressions/clicks.
  • Use the Service to transmit malware or illegal content.
  • Interfere with or disrupt the integrity or performance of the Service.

4. Intellectual Property

The Service and its original content (excluding content provided by you), features, and functionality are and will remain the exclusive property of MintyGum LLC and its licensors.

5. Payments and Subscriptions

Certain parts of the Service may be billed on a subscription basis or usage basis (e.g., ad revenue share or API calls). You agree to pay all fees associated with your use of the Service in accordance with the pricing terms presented at the time of purchase.

6. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms (e.g., detecting fraudulent ad activity).

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall MintyGum LLC, its directors, employees, or agents be liable for any indirect, punitive, incidental, special, or consequential damages, including without limitation, loss of profits, data, or goodwill. Our total liability to you shall not exceed the amount you paid us during the six (6) months prior to the event giving rise to the liability.

8. “AS IS” Disclaimer

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. MintyGum LLC makes no representations or warranties of any kind, express or implied, regarding the operation of the Service or the information, content, or materials included therein.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
